Website and Service Use

By access of any Service or Product order from Forever Young eBike (“Forever Young E-Bike.”) or ForeverYoungeBike.com website (the “Website”), you (“Customer”) agree to be bound by the terms and conditions listed below. You and Forever Young eBike (“Forever Young E-Bike.”) or ForeverYoungeBike.com agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and Forever Young eBike.  By using the website and our services only for purposes that are permitted by this Terms and Conditions and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. You agree that you will not access or attempt to access the Website other than through the interface that is provided by ForeverYoungeBike.com unless you have specifically been permitted to do so in a separate written agreement signed by an authorized representative of ForeverYoungeBike.com. You specifically agree not to access or attempt to access the Website, or any portion thereof, through any automated means, including but not limited to the use of scripts or web crawlers. You agree that you will not engage in any activity that disrupts or otherwise interferes with the Website (or the servers and networks which are connected to the Website) and agree to the terms by using the website, Services, and Products.

Once an order is placed, If you need to cancel your order for any reason, we cannot guarantee that we will be able to cancel your order before your bicycle is shipped from the warehouse. If we are unable to cancel your shipment, you will need to follow the warranty and returns policy for your bike's brand after delivery of your product. Please read your specific bike's brand policy on our Warranty and Refunds page.


International Shipping Rates (including to Hawaii, Alaska and Puerto Rico)
Shipping rates and free shipping on our site are only valid in the lower 48 states. We certainly can ship bicycles internationally, but we will have to send you a separate invoice to pay after your order. Please contact us if you live in another country, or Alaska/Hawaii/Puerto Rico, so we can give you a grand total with shipping charges before you finalize your order.

Inventory Notice
The bike, part or accessory may be out of stock at the time you purchase it. If this happens, you will receive an email stating that the color and/or size of bicycle you ordered is out of stock temporarily. If your bicycle is out of stock, we will provide you with as many substitute options as possible, but if for some reason you don’t like any of the options we give you, then we can refund your purchase. We do not offer any monetary compensation for items being out of stock.

All of our bicycles need to be adjusted and tuned prior to the first ride. This includes truing of wheels, adjusting derailleurs, and brakes, and this cost is the responsibility of the buyer. If the bike isn’t assembled and tuned up by a professional bike mechanic, and something breaks, the warranty may not cover it because the buyer may have been negligent during the assembly/tuning process.

Component Colors
Your bicycle may arrive with different color components than are shown in the picture. This happens because the factory that produces the bicycles changes the component colors sometimes without notice. Please email us if that happens. We will do everything we can to make sure you are completely satisfied with your new bike.

Replacement Parts
It may take a week or two or more for replacement warranty parts to arrive, for example if they are on backorder it can take up to 1-2 months for replacement parts to ship, but most times they arrive within a reasonable amount of time. If there is a delay with a replacement part for a warranty claim, we will contact you quickly to let you know.

Assembly
*You must have your bike assembled by a certified professional bicycle mechanic. Failure to do so will void the warranty.

All complete bikes are sold and delivered partially assembled. Final assembly should be done by a qualified bike technician. Failure to have the bike assembled by a qualified technician will void the warranty and could result in damage and/or injury if not assembled correctly. The bikes may arrive with untrue wheels (wobbly wheels) and derailleurs or brakes that need to be adjusted. This should be done by a qualified bicycle mechanic. Costs including but not limited to assembly fees incurred by the customer's own volition are not covered. This means, if you pay for parts and labor on your own, we won't pay for it unless we specifically authorized it.

Order the Correct Size
We recommend you go to a local bike shop to find out what size you need. A good shop will be happy to help you find the size you need. Please make sure that the bicycle you are ordering is the correct size for you before you place your order. If the size of bike you order is the incorrect size, then the standard return policy will apply, which means you’ll be liable for return shipping costs, initial shipping costs if the bike was shipped free, and a 20% restock fee. Shipping Damage
As an industry standard, some bikes might have minor cosmetic blemishes due to the nature of shipping. The warranty doesn’t cover small scratches in paint due to shipping damage.

If your bike sustained damage in shipping, the manufacturer will replace any of the parts that were damaged. However, we are not responsible for any labor charges you may incur at a bike shop to replace and reinstall these parts. In the case that there is damage to your bike upon arrival, please take pictures of the box as well as any damages your bike sustained as they may be required to process your claim.

Inspection: Please inspect the item before assembly or discarding any packaging. Returned items that arrive damaged, used or otherwise not as-new and/or without original packaging are refunded on a pro-rated basis.

If your bike is being delivered "Signature Required" plan accordingly (all Electric Bikes and all bikes over $500 are shipped "Signature Required").

When you receive your shipment, ask the carrier the following questions:
1. Is it damaged? Check for holes, water stains, and tears. Check to see if package has been opened. Listen for something broken inside. 
2. If your delivery doesn't check out, do the following: 
If only partially damaged, accept it and note exceptions on delivery receipt. 
DO NOT REFUSE SHIPMENT (aka Refusing Delivery)! 
3. Write down all exceptions on both copies of the delivery receipt, and have driver sign his full name. After the driver signs, you sign also. 
4. Unpack your bike box and if you have any missing parts or damaged parts email our Customer Care Team with your findings: support@ForeverYoungEbike.com. Do not assemble your bicycle until you hear back from us regarding any missing or damaged parts.

If you refuse shipment, and have not received an RMA Number (Return Merchandise Authorization Number) from either ForeverYoungEbike.com or the manufacturer of your product prior to refusing shipment (aka Refusing Delivery), then the return policy will apply AND you will not be refunded for the original shipping costs.

Refund/Return Policy:

Original sales receipt must accompany returns. Please note that the Refund/Return policy varies based on the bicycle brand that you purchase. Please review the Refund/Return policy for your specific bicycle brand manufacturer on the Warranty page. If there is no Refund/Return policy stated for your bicycle brand on the Warranty page, the following Refund/Return policy applies:

We accept returns for exchange or refund 5 calendar days after delivery of the product. At our sole discretion after 5 calendar days, we will offer an exchange or store credit only. Buyer is responsible for return shipping costs if seller is not at fault. If your bike was shipped free, then the original shipping costs will be deducted from your return refund. There is a 20% restocking fee for returned items that are not being exchanged and are not damaged.

Items must be in “new, unaltered and unused condition”. Definition of new, unaltered and unused condition is:

1) Without showing signs of wear or damage in any way

2) Original packaging must be in good condition or new packaging that is in good condition

3) Within 5 calendar days of the delivery date (after 5 days no returns are allowed)

4) Must not be a customized or special order

Refunds are contingent upon inspection of item(s) once we receive it.

You must contact us within 5 days if you intend to return any item. Items returned to us after 5 days and without contacting us will not be refunded.

Please keep in mind that once an order has shipped, it can’t be cancelled. Our return policy will apply.

We provide our Services and Products using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we don’t promise about our Services and Products.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER Forever Young eBike. NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES AND PRODUCTS. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE USAGES OF THE PRODUCTS, THE SPECIFIC FUNCTIONS OF THE PRODUCTS, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE PRODUCTS “AS IS”.

SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES AND LIABILITIES.

Liability for our Services

WHEN PERMITTED BY LAW, FOREVER YOUNG EBIKE WILL NOT BE RESPONSIBLE FOR INJURIES, ACCIDENTS, OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

IN ALL CIRCUMSTANCES TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF FOREVER YOUNG EBIKE, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICES AND PRODUCTS ONLY (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICES AGAIN).

IN ALL CASES, FOREVER YOUNG EBIKE AND SUPPLIERS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

Legal Status

All electric bicycles meet national DOT requirements for street use as a class 1-2 electric bicycle, however, they may not meet local laws and regulations. No guarantee is provided regarding local jurisdiction and electric bicycle laws.

Business uses of our Services

If you are using our Services or Products on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Forever Young eBike, Sells Digital LLC, and its employees, officers, affiliates from any claim, suit or action arising from or related to the use of the Services and Products or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.

About these Terms and Conditions

We may modify these terms or any additional terms that apply to a Product or Service to, for example, reflect changes to the law or changes to our Services and Products. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service or Product, you should discontinue your use of that Service or Product.

If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.  These terms control the relationship between Forever Young eBike and you. They do not create any third party beneficiary rights.  If you do not comply with these terms, and we do not take action right away, this does not mean that we are giving up any rights that we may have (such as taking action in the future).  If it turns out that a particular term is not enforceable, this will not affect any other terms.
